1. The service
Apheles is an AI-powered marketing platform that helps small and growing businesses plan, create, and optimise marketing across connected channels such as paid ads and email. Apheles produces recommendations and draft content; you remain in control and decide what to approve, edit, or publish.
2. Eligibility
You must be at least 18 and able to form a binding contract. Apheles is intended for business use.
3. Your account
You are responsible for the accuracy of your account details, for keeping your credentials secure, and for activity under your account. Tell us promptly at kiran@apheles.com if you suspect unauthorised use.
4. Connected third-party platforms
Apheles works by connecting to third-party platforms (for example, Meta, Klaviyo, and Mailchimp). Your use of those platforms remains subject to their own terms and policies, and you are responsible for complying with them, including each platform's advertising rules. We are not responsible for third-party platforms or for changes they make to their services or APIs.
5. Acceptable use
You agree not to: use Apheles for anything unlawful, deceptive, or infringing; violate the policies of any connected platform; attempt to disrupt, reverse-engineer, or gain unauthorised access to the service; or use it to generate content that is illegal, harmful, or misleading.
6. Your content & data
You retain ownership of the business information, brand samples, and other content you provide. You grant us a limited licence to process that content solely to operate and improve the service for you. You are responsible for ensuring your content and your published marketing are accurate and lawful.
7. AI-generated output & results
Content and recommendations produced by Apheles are suggestions to help you decide; they are not guarantees. You review and approve what goes live, and you are responsible for what you publish. Marketing results vary, and we do not warrant any particular return on ad spend, revenue, ranking, or other outcome.
8. Plans, fees & billing
Paid plans start at $99/month and are billed through Stripe on a recurring basis until cancelled. Fees are charged in advance and, except where required by law, are non-refundable. You can cancel at any time, effective at the end of the current billing period. We may change pricing with reasonable notice; changes take effect at your next renewal.
9. Early access
Some features or plans may be offered as early access or beta. They are provided "as is", may change or be withdrawn, and may be less reliable than generally available features.
10. Intellectual property
We own the Apheles platform, software, and brand. You own your content. Nothing in these Terms transfers ownership of our platform to you or of your content to us.
11. Disclaimers
The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or that it will produce any particular marketing result.
12. Limitation of liability
To the fullest extent permitted by law, Apheles will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the claim arose.
13. Termination
You may stop using Apheles and delete your account at any time. We may suspend or terminate access if you breach these Terms or to protect the service or other users. On termination, your right to use the service ends and your data is handled as described in our Privacy Policy and Data Deletion pages.
14. Changes to these Terms
We may update these Terms as the product evolves. We will revise the date above and, for material changes, notify you. Continued use after changes take effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of India, without regard to its conflict-of-laws rules. The courts located in India will have exclusive jurisdiction over any disputes, unless applicable law requires otherwise.
